it consists of territorial waters belonging to Iran and Oman, Iran never ratified the 1982UNCLOS, and neither did the usa.
that very UNCLOS is the only reason why passage through certain "straits used for international navigation" would be recognized, so if the usa never ratified it, and neither did one of the very states that actually own the waters, why would you make that claim?
consequently, under customary international law, the two coastal states have rights over these waters that must be respected
