That's prohibited where I live. (Students shouldn't be evaluated just by conduct alone)
Mastering the content of the course is the only thing you should grade no matter how that student might behave or act during class.
However, you can only grade conduct IF it's associated with the class goals, and explain the student how that behavior affect his grade. But you can never evaluate conduct alone.
The instructor and personnel of the school should follow a process and avoid taking arbitrary actions if the student has some issues that need to be resolve, simple.
